The 2026 Portugal Property Buying Guide
Acquiring property in Portugal is an exciting prospect, but navigating a foreign legal and administrative system requires clarity and preparation. This guide outlines the essential phases of purchasing a home as an international buyer in 2026.
1. Preparation and Representation
Before searching, it is imperative to assemble your team. In Portugal, the notary acts for the state, not the buyer or seller. Therefore, appointing an independent, bilingual Portuguese lawyer (Advogado) is the critical first step. They will conduct due diligence and ensure clear title.
You must also obtain a Portuguese Fiscal Number (NIF - Número de Identificação Fiscal). This is required for any transaction and opening a local bank account, which is necessary for transferring funds and setting up utility direct debits.
2. The Promissory Contract (CPCV)
Once a price is agreed upon and your lawyer has completed initial checks, both parties sign the Contrato de Promessa de Compra e Venda (CPCV). This legally binding document outlines the terms, conditions, and completion date.
At this stage, the buyer pays a non-refundable deposit—typically between 10% and 30% of the purchase price. Under Portuguese law, if the buyer defaults, they lose the deposit. If the seller defaults, they must return double the deposit amount.
3. Taxes and Fees
Buyers should budget approximately 7% to 10% of the purchase price for acquisition costs. The primary taxes are:
- IMT (Property Transfer Tax): A sliding scale based on the property's value and purpose (primary residence vs. second home).
- Stamp Duty (Imposto de Selo): Currently fixed at 0.8% of the purchase price.
- Notary and Registration Fees: Usually between €800 and €1,500.
- Legal Fees: Typically 1% to 1.5% of the purchase price, plus VAT (IVA).
4. Completion (Escritura)
The final deed of sale (Escritura Pública de Compra e Venda) is signed in front of a Portuguese Notary. The remaining balance of the purchase price, along with the applicable taxes, must be paid at this time. Following the signing, the property is officially registered in your name at the Land Registry (Conservatória do Registo Predial).
